Kelly Burris Discusses Unusual Texas Child Custody Case
Cordell & Cordell Litigation Partner Kelly L. Burris recently conducted a pair of interviews on Houston radio stations about a potentially groundbreaking child custody case making its way through Texas family court.
The case involves a 4-year-old girl whose mother was killed in a car crash. After the accident, a court granted custody to the mother’s boyfriend, who had only lived with the child for a few months, even though the child’s father wants custody.
What is unusual about the case is that all parties involved agree that the father is fit as a parent.
“If a non-parent has raised a child, tearing a child away from that person could be detrimental for the child, but that does not appear to be the case here,” Ms. Burris said. “As long as there is no serious concern regarding the welfare of a child, a parent’s right to make decisions for his child, including who should associate with the child, is paramount to raising kids.”
