Joseph Cordell Discusses Financial Advisors and Divorce

financial advisor magazineFinancial advisors and divorce are the focus in Cordell & Cordell Principal Partner Joseph Cordell’s recent column for Financial Advisor Magazine.

In his August 2014 article, “Five Steps to Helping Divorcing Clients,” Mr. Cordell outlines different actions financial advisors can take to better prepare themselves for dealing with clients going through divorce.

Mr. Cordell emphasizes the importance of obtaining Certified Divorce Financial Analyst accreditation as well as sharpening marketing focus, getting information out about accreditation and experience, developing a revenue model for divorcing clients and, ultimately, cultivating a divorce-friendly environment.

“Relationships formed during those trying times not only take a weight off the shoulders of the person going through a divorce but also help create enduring associations that can last for decades after the divorce is finalized,” said Mr. Cordell.

Two Cordell & Cordell Attorneys Named Mountain States Rising Stars By Super Lawyers

super lawyers 2014Two Cordell & Cordell attorneys were selected to the 2014 Mountain States Rising Stars list for family law attorneys by Super Lawyers, a Thomson Reuters business.

Jonathan Winn (Salt Lake City, Utah) and Brandon Leavitt (Henderson, Nevada) were both selected to this list for the first time.

Each year, no more than 2.5 percent of the lawyers in the state are selected by the research team at Super Lawyers to receive this honor.

Super Lawyers is a rating service of outstanding lawyers from more than 70 practice areas who have attained a high degree of peer recognition and professional achievement.

The annual selections are made using a patented multiphase process that includes a statewide survey of lawyers, an independent research evaluation of candidates and peer reviews by practice area.

Lawyers are asked to nominate the best attorneys who are 40 years old or under, or who have been practicing for 10 years or less, and who they have personally observed in action.

Principal Partner Joe Cordell Speaks with Money Radio about Financial Aspects of Divorce

On June 12, Cordell & Cordell Principal Partner Joe Cordell spoke with on the Phoenix-based radio show “Business for Breakfast” on Money Radio.

Mr. Cordell explained the importance of understanding financial matters during complicated divorce situations.

“It’s a critical moment in life, but it’s important to make rational decisions,” said Mr. Cordell. “In part, these decisions can be impacted by emotions and also by not getting the best financial advice.”

Mr. Cordell discussed the fact that there are certainly divorce attorneys with financial or business knowledge, backgrounds or experience, but that it’s often wise for attorneys to reach out and hire individuals who are financial experts.

On the show, Mr. Cordell was asked about issues related to splitting investments or assets during divorce. Mr. Cordell mentioned that while the agreement can be to split everything in half, determining what items go to which party can often be complicated.

“It’s critical to see a lawyer early on,” explained Mr. Cordell. “You have a professional involved then who can advise along the way. Many times, people wait too long. The party who has expert advice first has an advantage.”

Joe Cordell Writes Another Column for Financial Advisor Magazine About Tax Expertise

Financial Advisor magazineCordell & Cordell Principal Partner Joseph Cordell recently contributed another column to Financial Advisor Magazine.

In “Tax Expertise: A Valuable Skill Throughout Divorce,” Mr. Cordell explained that attorneys are not always aware of as many tax subtleties as financial advisors. He described the benefits that financial advisors can bring to the entire divorce process, particularly with regard to explaining statues on taxes.

Mr. Cordell wrote that such financial advisors could catch oversights and be beneficial to both parties in a divorce case.

“Knowing the tax rules can allow you to achieve more subtle gains in settlements. You can often surmount roadblocks in settlement negotiations with imaginative and beneficial solutions using the subtleties of tax law,” said Mr. Cordell. “It may be that one party can walk away with a post-tax sum that was equal to the other party’s, even though it appears the former received nominally more in the pretax settlement.”

Mr. Cordell mentioned that taxes often impact issues related to alimony, child support, dependent exemptions, property division, home sales exclusion, deferred compensation with retirement assets and more.

He described the different roles financial advisors could potentially play in a divorce situation pertaining to one or more of the issues above.

“Advisors could lend their expertise as consultants during the settlement negotiations, as expert witnesses during litigation or as behind-the-scenes advisors helping prepare one party for trial. All of these functions allow them to identify relevant tax issues and design creative solutions that attorneys all too often overlook,” said Mr. Cordell.
