If a father is not married at the beginning of the pregnancy or at the birth of his child, he must seek a declaration of paternity to legally establish a parent-child relationship.
The non-custodial parent may sign legal documents establishing paternity and the court will adopt the stipulation in a final order. The court also may hold a hearing to establish paternity.
The father and mother can establish paternity by signing an affidavit stating the child is theirs. This is the easiest way to establish paternity and avoids going to court.
Establishing paternity enacts several parental rights such as the right to seek child support or custody and to have a say in certain legal decisions regarding the child.
