Two bills passed by the Tennessee legislature have drastically improved fathers’ rights in Franklin. The first, passed in 1997, states that “the gender of the party seeking to be the primary residential parent shall not give rise to a presumption of parental fitness,” which explicitly states that gender is not be used in a discriminatory fashion when determining custody.

This law helped eliminate the explicit bias against dads’ rights in Franklin, but the implicit bias remained. The second law, passed in 2011, requires judges to attempt to maximize both parents’ involvement in their children’s lives. 50/50 custody splits are not explicitly mandated, but they are certainly becoming more common and Franklin fathers’ rights are being respected to a greater degree.
